미국 캘리포니아 북부 새크라멘토라는 지역에는 신천지 LA 요한지파의 지부가 있다. 주정부에 등록된 이곳의 공식 명칭은 ‘샌프란시스코 시온교회’(San Francisco Zion Church)이다. 이곳은 신천지임을 드러내지 않고 일반 교회인 것처럼 웹사이트를 운영하고(https://sfzion.org/), 일반 성경공부 모임인 것처럼 여러 개의 성경공부 웹사이트를 만들어 사람들을 신천지 성경공부로 유인한다. 그들이 운영 중인 대표적인 성경공부 웹사이트는 두 개가 있는데, 그중에 하나가 ‘모두를 위한 성경공부(Bible Study for All’https://biblestudyforall.org/)이고, 또 다른 하나는 ‘북가주 선교회(NorCal Missions)’(https://norcalmissions.org/)이다.

얼마전 ‘북가주 선교회’의 성경공부 모임에서 탈퇴한 한 탈퇴자는 필자에게 충격적인 제보를 했다. 보통 신천지가 성경공부를 시작할 때 등록 신청 같은 것을 통해 개인의 신상정보 등을 받고 사인도 하는데 샌프란시스코 시온교회는 여기서 더 나아가 참석자들에게 NDA(Non-Disclosure Agreement)를 받는다는 내용이었다.

한국말로 하면 “기밀 유지 협약”이다. 이 탈퇴자는 성경공부를 시작하기 전에 ‘북가주 선교회’로부터 받은 이메일을 통해 한 문서를 받고 아무 생각없이 사인을 해서 넘겨주었는데, 후에 탈퇴하고 나서 그 문서를 다시 보니 그 문서는 다름 아닌 기밀 유지 협약이었다.

문서엔, 성경공부 자료, 사진, 파일, 주소, 신상정보, 참가자 본인이 기록한 노트 등 어느 하나라도 유출하거나 공개할 경우 법적인 책임을 질 수 있다고 기록되어 있었다. 심지어 신천지가 법적 분쟁에서 패소한 경우에도 변호사 비용을 신천지가 아닌 고소인이 모두 지불해야 한다는 조항까지 포함되어 있었다.

성경공부를 위해 기밀 유지 계약을 맺는다니 기가 막힐 노릇이다. 참가자는 위의 계약서에 사인을 하면서도 본인이 작성한 계약서가 신천지에게 법적으로 일방적이고, 압도적으로 유리하게끔 작성되어 있다는 것은 꿈에도 상상을 하지 못한다. 성경공부를 위해 이런 계약이 맺어진다는 것을 누가 상상하겠는가? 참가자들은 대부분 잘 살펴보지 않고, 그냥 이 종이에 사인을 하게 된다.

신천지는 요즘 오픈 포교를 한다고 대대적인 홍보를 한다. 그런데 도대체 무엇을 오픈한다는 것일까? 그들은 사람들을 포섭할 때 절대로 그들의 핵심 교리를 말하지 않는다. 신천지에 포섭된 사람 어느 누구도, “이만희 총회장은 약속의 목자이며, 오직 그 약속의 목자를 통해서만 구원을 얻을 수 있다”와 같은 말을 듣고 신천지의 성경공부에 참여한 사람은 없다. 왜냐하면, 그것을 말하는 순간 아무도 그 성경공부에 참여하지 않기 때문이다.

신천지는 성경공부를 하는데 “기밀 유지 협약”을 맺어야 할 만큼 감춰야 할 것이 많다. 정말 일반적인 사람들은 도저히 상상도 할 수 없는 일이다. 자신들의 목적을 위해 사람들을 속이고, 기만하는 것은 절대로 옳은 일이 아니다. 신천지는 종교가 아니라 종교와 성경을 이용해 이만희 개인의 욕망을 채우는 사기를 저지르고 있는 것이 명백하게 드러나는 대목이다.

아래는 필자가 번역한 그들의 NDA기밀 유지 협약 문서이다. (참고 사항: 아래 문서에서 신천지 새크라멘토 요한지파는 자신들의 성경공부 단체 이름을 “샌프란시스코 시온교회”, “북가주 선교회”, 혹은 “신천지 새크라멘토 요한지파” 등으로 사용하지 않고, “성경공부 프로그램”(THE PROGRAM)이라는 이름으로 지칭하고 있다. 신천지가 성경공부를 주관하고 있다는 것을 감추고 있다.)

‘성경공부’ THE PROGRAM 참여 동의서
이 계약은 “성경 공부 프로그램” (“THE PROGRAM”)의 주요 대표자 및 조직과 __________________ 사이에 체결된다.
(“참가자”)는 아래에 정의된 대로 기밀 정보의 무단 공개를 방지하기 위한 목적으로 사용된다.
양 당사자는 특정 소유권 및 기밀 정보(“기밀 정보”)의 공개와 관련하여 기밀 관계를 맺는 데 동의한다.
THE PROGRAM은 THE PROGRAM 내 참가자의 정보를 포함하여 THE PROGRAM의 기밀 정보를 보호하고 모든 참가자가 이 정보의 기밀성을 유지하는데 동의하는지 확인하고자 한다.
참가자는 THE PROGRAM이 기밀 정보를 보호하기를 원하고, 자신의 참여가 기밀 정보와 관련하여 THE PROGRAM에 대한 신뢰 및 기밀 유지 의무를 발생시키는 것을 인정하며, THE PROGRAM에 참여하는 조건으로서, 참가자는 본 계약 조건에 구속되는 것에 동의한다.

기밀 유지 계약
따라서 THE PROGRAM 및 참가자는 다음과 같이 동의한다.​

‘BIBLE STUDY’ THE PROGRAM PARTICIPATION AGREEMENT
This Agreement is entered into between the principal representatives and organization of the Bible Study Program (“THE PROGRAM”) and ___________________
(“Participant”) for the purpose of preventing the unauthorized disclosure of Confidential Information as defined below.
The parties agree to enter into a confidential relationship concerning the disclosure of certain proprietary and confidential information(“Confidential Information”).
The Program wishes to protect its confidential information, including information of participants within the Program, and ensure that all Participants agree to maintain the confidentiality of this information.
Participant acknowledges that THE PROGRAM desires to protect its confidential information, that his/her participation creates a duty of trust and confidentiality to THE PROGRAM with respect to its confidential information and, as a condition of participation with THE PROGRAM, Participant agrees to be bound by the terms of this Agreement.

Confidentiality Agreement
WHEREFORE, THE PROGRAM and Participant agrees as follows:​

제1조: 기밀 정보
A. “기밀 정보”란 THE PROGRAM, THE PROGRAM의 활동, 교육 자료 또는 참여자와 관련하여 조직 외부에 일반적으로 알려지지 않은 정보 및 데이터를 의미한다. “기밀 정보”에는 THE PROGRAM의 활동, THE PROGRAM의 이벤트, THE PROGRAM의 프로젝트, 교육 자료, 오디오 파일 CD, 인쇄물, 전단, 브로슈어, 교육 목적 삽화, 상표권 자료, 오디오 파일, 비디오 파일, 주소, 프로젝트 사진, 파일, 이벤트, 교육 개요, 다이어그램, 컴퓨터 기록의 ID, 서면 기록, 입력된 기록, THE PROGRAM의 수업이나 이벤트의 노트, 시험지와 파일, 운영 계획, 재무 기록, 로고, 엠블럼 및 THE PROGRAM과 THE PROGRAM 참가자의 활동과 관련된 모든 다른 개념 또는 아이디어 등이 포함된다.

참가자는 THE PROGRAM에 참여하는 동안 및/또는 THE PROGRAM을 종료한 후 THE PROGRAM 내부 또는 외부의 누구에게도 기밀 정보를 공개하지 않기로 동의한다.

참가자는 THE PROGRAM 참여 중 및/또는 THE PROGRAM 종료 후 THE PROGRAM 기밀 정보의 녹화(비디오, 오디오, 스크린숏 또는 사진)를 촬영하지 않기로 동의한다. 이는 참가자의 신원, 개인 정보, THE PROGRAM 기밀 정보 및 개인 소유의 교육 자료를 보호하기 위한 것이다.

B. 참가자는 기밀 정보가 THE PROGRAM에 의해 수집된 사적인 자료와 정보를 구성한다는 것을 이해하고 동의한다. THE PROGRAM은 이 정보의 기밀성을 보호하기 위해 모든 합리적인 조치를 취했습니다.

C. 참가자는 기밀 정보가 THE PROGRAM의 독점적 자산으로 유지되며, THE PROGRAM의 사전 서면 동의 없이 어떠한 경우에도 THE PROGRAM으로부터 유출되지 않는데 동의하며, 유출되었을 경우, 참가자는 참여가 종료되는 즉시 THE PROGRAM에 반환되어야 하며, 참가자는 그 사본을 보관할 수 없다.

D. 기밀 정보 및/또는 독점 데이터를 포함하거나 관련된 모든 노트, 공책, 메모, 그림, 사진, 녹음(비디오 및/또는 오디오), 컴퓨터 디스크 및 기타 유사한 정보의 저장소는 참여 종료 시 THE PROGRAM의 재산이다. 참가자가 작성하거나 편집하거나 참가한 기간 동안 참가자가 이용할 수 있도록 만든 모든 항목(모든 사본 포함)은 THE PROGRAM 탈퇴 후 5일 이내에 또는 THE PROGRAM의 요청에 따라 참가자가 THE PROGRAM에 전달해야 한다.

E. 참가자는 허가받지 않고 기밀 정보 및 독점적 데이터를 사용 또는 공개 시, 캘리포니아 및 기타 다른 주, 또는 연방법원을 포함한 미국 내 적법한 어떤 법원에서든 금전적 손해배상 및 형평법상 구제방법을 신청하기 위한 법적 소송 사유가 될 수 있음을 이해하며, 참가자에게 손해배상을 청구할 권리를 포기하지 않음과 동시에, THE PROGRAM은 해당 기밀 정보 및 독점 데이터의 불법적인 사용 또는 공개를 금지하는 가처분 신청을 할 권리가 있다.

ARTICLE 1: CONFIDENTIAL INFORMATION
A. The terms “Confidential Information” mean information and data not generally known outside the organization concerning THE PROGRAM, its activities, its educational materials, or its participants. “Confidential Information” includes, but is not limited to, information on THE PROGRAM’s activities, THE PROGRAM’s events, THE PROGRAM’s projects, educational materials, audio file CDs, print-outs, flyers, brochures, education-purposed illustrations, trademarked material, audio files, video files, addresses of locations, photographs of projects, files, and events, educational outlines, diagrams, identity of computerized records, written records, typed records, notes from THE PROGRAM’s lessons or events, examination papers and files, operation plans, financial records, logo, emblem, and all other concepts or ideas involving or reasonable related to the activities of THE PROGRAM and its participants.

The Participant agrees to not disclose the Confidential Information to anyone within or outside of THE PROGRAM during their participation with THE PROGRAM and following any termination in participation with THE PROGRAM.

During the participation and/or after termination from THE PROGRAM, the Participant agrees not to take recordings (video, audio, screenshots, or pictures) of THE PROGRAM's Confidential Information. This is to protect participants' identities, privacy, as well as the Confidential information and privately-owned educational materials of THE PROGRAM.

B. Participant understands and agrees that the Confidential Information constitutes private material and information gathered by THE PROGRAM. THE PROGRAM has taken all reasonable steps to protect the confidentiality of this information.

C. Participant agrees that the Confidential Information shall be and remain the exclusive property of THE PROGRAM, and shall not be removed from the premises of THE PROGRAM under any circumstances whatsoever without the prior written consent of THE PROGRAM and if removed, shall be immediately returned to THE PROGRAM upon any termination of Participants’ participation, and no copies thereof may be kept by Participant.

D. All notes, notebooks, memorandums, pictures, photographs, recordings (video and/or audio), computer disks and other similar repositories of information containing or relating in any way to Confidential Information and/or Proprietary Data shall be the property of THE PROGRAM upon termination of participation. All such items made or compiled by Participant or made available to Participant during the period of participant, including all copies thereof, shall be delivered to THE PROGRAM by Participant within 5 days upon termination of participation with THE PROGRAM, or at any other time upon the request of THE PROGRAM.

E. Participant understands that the use or disclosure of any of the Confidential Information and/or Proprietary Data may be cause for an action at law or in equity in an appropriate court of the State of California, or of any state of the United States, or in any federal court, and that without waiving the right to collect damages from Participant, THE PROGRAM shall be entitled to an injunction prohibiting the use or disclosure of the Confidential Information and Proprietary Data.

제2조: 명예훼손 금지

참가자는 THE PROGRAM에 대한 참가자의 참여 과정 동안, 그리고 그 이후 어떠한 경우에도 직접적 또는 간접적으로, 공적으로나 사적으로나, 어떠한 방법으로든, 어떠한 방식으로든, 반대, 반론 또는 그 밖의 어떠한 의견, 글, 발언 또는 그 밖의 표현도 해서는 안 되며, 이는 THE PROGRAM의 명예를 훼손하는 것으로 해석될 수 있다. 또한 참가자는 어떤 다른 사람, 기업 또는 회사가 그렇게 하도록 도와서는 안 된다.

명예훼손은 THE PROGRAM, THE PROGRAM 내 참가자 또는 THE PROGRAM 참가자와 관련된 사람(부모, 친구, 지인, 주요 타인을 포함하지만 이에 국한되지 않음)에 대한 잠재적, 인식 또는 실질적인 피해로 정의될 것이다. 명예훼손에는 THE PROGRAM 또는 THE PROGRAM의 이벤트, 활동, 멤버 및 스태프에 대한 부정적인 진술이 포함되지만 이에 국한되지 않는다. 부정적인 진술은 THE PROGRAM에 의해 정의되며, THE PROGRAM, 그 참가자, 활동 또는 관련 개인의 명예를 고의로 해치려는 진술로 정의된다.

ARTICLE 2: NON-DEFAMATION
The Participant shall not, during the course of the Participant’s participation in THE PROGRAM, nor at any time thereafter, directly or indirectly, in public or private, in any manner or in any medium whatsoever, deprecate, impugn or otherwise make any comments, writings, remarks or other expressions that would, or could be construed to, defame THE PROGRAM. Nor shall the Participant assist any other person, firm or company in so doing.

Defamation will be defined as potential, perceived, or real harm to THE PROGRAM, participants within THE PROGRAM, or people related to the participants of THE PROGRAM (including, but not exclusive to, parents, friends, acquaintances, significant others). Defamation will include, but not be limited to, negative statements about THE PROGRAM or THE PROGRAM’s events, activities, members, and staff. Negative statements shall be defined by THE PROGRAM, and as statements that seek to purposely harm the reputation of THE PROGRAM, its participants, its activities, or affiliated individuals.

제3조: 관계의 본질
양 당사자는 참가자와 THE PROGRAM의 관계가 “자유롭게” 종료될 수 있다는 것을 이해하고 동의하며, 따라서 참가자가 위에서 언급한 계약 중 어느 하나를 위반한 것으로 판단되거나, THE PROGRAM이 참가자가 참가하기에 부적합하다고 판단되는 경우, THE PROGRAM이 참가자에게 사전 통지나 이유 없이 관계를 종료할 수 있다.

참가자 또한 종료 사유에 대한 설명과 함께 THE PROGRAM에 대한 사전 통지를 통해 관계를 종료할 수 있다. 관계가 종료되면, 참가자는 THE PROGRAM 참여 종료 후 5일 이내에 또는 THE PROGRAM의 요청에 따라 언제든지 THE PROGRAM에 전달해야 한다.

ARTICLE 3: NATURE OF RELATIONSHIP
The parties understand and agree that Participant’s relationship with THE PROGRAM is terminable “at will” such that THE PROGRAM may terminate the relationship with or without cause or prior notice to the Participant if the Participant is judged to have violated any of the agreement mentioned above, or if THE PROGRAM deems the participant to be unfit for participation.

The Participant may also terminate the relationship with prior notice to THE PROGRAM, with explanation of termination reason. Upon termination of the relationship, the Participant must deliver to THE PROGRAM within 5 days upon termination of participation with THE PROGRAM, or at any other time upon the request of THE PROGRAM.

제4조: 기타 조항
본 계약의 모든 조항은 시행 목적을 위해 분리될 수 있다. 본 계약의 어떤 조항이나 항목이 법률상 또는 형평성에 있어 시행할 수 없는 경우, 해당 조항이나 항목은 본 계약의 나머지 부분과 분리되며, 본 계약의 나머지 부분은 해당 조건에 따라 계속 시행될 수 있다.

본 계약은 그 주제에 관한 전체 계약을 명시한다. 본 계약의 변경, 수정, 종료 또는 포기는 서면으로 작성되고 정식으로 권한을 위임 받은 THE PROGRAM의 대리인에 의해 서명하지 않는 한 구속력을 가질 수 없다. THE PROGRAM이 본 계약의 조건, 약관 또는 조건을 엄격하게 준수하지 않는다고 해서 해당 조건, 약관 또는 조건의 포기로 간주되지 않는다.

본 계약은 본 계약서의 주제와 관련된 양 당사자 간의 전체 계약을 구성하며, 기밀 유지 및 명예 훼손과 관련된 양 당사자 간의 이전의 모든 계약을 대체한다.

본 계약과 관련된 분쟁이 발생할 경우, THE PROGRAM은 변호사 비용을 회수한다.

이상의 증거로, 양 당사자는 위에 기재된 날짜와 연도에 정식으로 권한을 부여 받은 담당자가 본 계약을 실행하도록 했습니다.

ARTICLE 4: MISCELLANEOUS PROVISIONS
All provisions of this Agreement shall be severable for purposes of enforcement. If any provision or clause of this Agreement is unenforceable at law or in equity, such clause or provision shall be severed from the remainder of this Agreement, and the remainder of this Agreement shall continue to be enforceable, according to its terms.

This Agreement sets forth the entire Agreement as to its subject matter. No modification, amendment, termination or waiver of this Agreement shall be binding unless in writing and signed by a duly authorized representative of THE PROGRAM. Failure of THE PROGRAM to insist upon strict compliance with any of the terms, covenants or conditions of this Agreement shall not be deemed a waiver of such terms, covenants or conditions.

This Agreement constitutes the entire agreement between the parties hereto relating to the subject matter hereof and supersedes any previous agreements between the parties relating to confidentiality and defamation.

In the event of any dispute related to this Agreement, THE PROGRAM shall recover its attorney fees.

IN WITNESS WHEREOF, the Parties have caused this Agreement to be executed by their duly authorized officers on the day and year first above written.
